US EPA Issues Draft of the Multi-Sector General Permit for Stormwater at Industrial Sites

US EPA issued a draft of the Industrial Stormwater Multi-Sector General Permit (MSGP).  The permit authorizes stormwater discharges from industrial activity at specific industrial categories and is only applicable to a few states (New Hampshire, Massachusetts, DC, Oklahoma, New Mexico), Federal Facilities (Vermont, Delaware, Colorado, Washington), and US territories (Puerto Rico, American Samoa, Guam, Johston Atoll, Midway Island & Wake Island, Northern Mariana Islands). The public comment period ends May 19, 2025.

Of note is the quarterly monitoring requirement for PFAS in stormwater discharges for most of the industrial sectors.

While this is only applicable to the few states and territories noted above, PFAS monitoring could be required in the next generation of MSGP permits or individual NPDES permits for states that have NPDES authority, like Ohio and many other states. This will be a significant compliance effort due to the expense of PFAS analysis and the additional procedures required for PFAS sampling.
